Terms and conditions of using our websites

Definition of terms
‘Cycle Breaks’ & ‘Walking Breaks’ & ‘Suffolk Cycle Breaks’ are all trading names of Andrew Patton and will be referred to as ‘We’ or ‘Us’ for the rest of this document.

Users of our websites (www.cyclebreaks.com and www.walkingbreaks.com), those making enquiries by email, telephone or fax and those booking holidays are referred to as ‘You’ or ‘Your’.

Access and use of our websites
This is subject to acceptance of these Terms and Conditions. If you do not agree to these conditions, you should stop using the site at once.

Accuracy of Information
Every reasonable effort is made to ensure that information will be accurate and up-to-date. This is done in good faith and we do not accept any liability for error or omission with regards to content of the site. We do not accept responsibility for the content of any third party site even where there is a hypertext link from this site.

Our Liability
We shall not be liable for any damages arising in contract, tort, or otherwise from the use of or inability to use this site, or any material contained in it, or from any action or decision taken as a result of using this site or any such material.

Legal Jurisdiction
These Terms and Conditions are governed by English law.

Website – Information collected

Our web server records visits to this website, and our websites also use cookies. A ‘cookie’ is information that a website stores on your computer so that it can remember something about you at a later time. The main purpose of a cookie is to identify users and to personalise their visit by customising a web page for their use. Our use of cookies does not involve the capture of personal details.

We use online tracking software to track the progress of visitors to our websites. Our software collects information about:

  • the pages which you have visited while browsing the site
  • computer information (eg IP address, browser, operating system, screen colours, screen resolution, flash version, java support, connection speed, language)
  • location (city and country).

We do not intentionally link this information with personally identifiable information.

We use the following cookies on our websites (using the classification from the International Chamber of Commerce cookie guide):

Category 1: strictly necessary cookies to enable you to use the website.

Category 2: performance cookies to enable our tracking software to collect anonymous data as described above. By using our website, you agree that we can place these types of cookies on to your computer/device.

Our websites contain links to third party websites – our privacy statement only applies to our own websites. For third party websites, please refer to their own privacy statements.

We consider that our websites use reasonable security procedures to maintain the confidentiality of the information you provide. The Internet is however an open public facility and no security measures are guaranteed.

Information we collect from you

If you book or make enquiries about booking one of our holidays or request a copy of our brochure, we will collect:

  • contact information for the person making the booking or enquiry (name, address, telephone number(s) and/or email address(es) as well as details of how you heard about us
  • personal information for members of your party where relevant (eg gender and height, age, rooming preferences and special dietary requests)
  • information collected in the post-holiday questionnaire (your satisfaction with our services, your occupation, age range of your party and household and  your future holiday interests)
  • we are PCI compliant and payment card data will be collected and securely stored by Sagepay where a booking request is made via our website. Where the booking is placed via telephone, card details are securely shredded after processing.

We will use this information:

  • to provide the requested service(s)
  • to monitor and improve the quality of our service
  • to profile and understand our client & customer base
  • for marketing communications where you have provided prior consent or where we are permitted under an identified and assessed legitimate interest
  • as client testimonials in our marketing materials (in anonymised form).

Legal basis for using your personal information:

  • to provide the requested service(s)
  • because there is a Legitimate Interest to use your personal data to operate or improve our business as a tour operator after an assessment of Legitimate Interest has been undertaken
  • because you have consented to us using your information
  • because we need to comply with a legal obligation.

When we share information that we collect from you

  • to hotels and overseas partners to provide the requested service
  • to third parties who act as data processors and undertake business functions on our behalf (such as payment processing, direct mail & email fulfilment, data analysis, cloud based business support services) to allow us to undertake legitimate business communications. NB we do not sell your data to any organisations and we do not share your data with any other organisations other than for the provision of requested services
  • we will also comply with requests for information from government agencies (UK or overseas) for law enforcement and compliance purposes. It may on occasion be appropriate to release this information to identify, contact or bring legal action against a person who may be causing injury or interference with another person’s rights or property.

Marketing Communications

We have been marketing directly to our clients since we started providing cycling holidays back in 1991.  Sending information on our services originally by post and more recently by email is very important to the way we do business.  We are however measured in our communications, limiting their frequency as we have no wish to be a burden to recipients, always offering an easily accessible opt-out from future marketing communications.

We use data that we have collected from bookings, brochure requests and holiday enquiries to decide what marketing information our clients may like to receive; we have identified and assessed this as our Legitimate Interest.

Data Subject Access Request

You may ask us in writing for a copy of the information we hold about you (for which we may charge a fee) and to correct any inaccuracies in your information. We will ask for some proof of identity so that we can be sure about that the request is legitimate.
